GoWin! Software END-USER LICENSE AGREEMENT This End-User License Agreement ("Agreement") sets forth the terms and conditions of your download /installation/use of GoWin! including the demo/trial version and the licensed version. You should carefully read the following terms and conditions before using the software and its documentation. Use of GoWin! is contingent on your agreement to the following terms: 1. LIMITATION OF LIABILITY - In no event GoWin! Software and any contributor to this software program shall be liable to any party for direct, indirect, special or other consequential or incidental damages arising directly or indirectly from the use of GoWin!, including but not limited to any lost profits or any other pecuniary loss, loss of information, business interruption, even if GoWin! Software has been expressly advised of the possibility of such damages. 2. DISCLAIMER OF WARRANTY � GoWin! and any related services, free or fee-based, are provided "AS-IS" without warranty of any kind. GoWin! Software does not warrant that this software and the accompanying data are error free and does not warrant that this software is fully compatible with all of your computer�s software. You must understand and agree that any service, either on a subscription basis or not, free or fee-based, in conjunction with GoWin! is provided "AS-IS" and that GoWin! Software assumes no responsibility for the continuity, timeliness, completeness or for the mis-delivery because of any reason, in providing of any data for this software program or in performing of any required task. You agree that GoWin! Software, in its sole discretion, may terminate any related service at anytime without any possible reclamation, and that the maximum remedy to a customer in this case will not exceed the equivalent fee for the remaining period of the service. To the maximum extent permitted by law we further disclaim all warranties including without limitations any implied warranties of merchantability and noninfringement. The entire risk arising out of the use or performance of GoWin! remains with recipient. To the maximum extent permitted by law, in no event shall GoWin! Software and any contributor to this software program be liable to any party for direct, indirect or other consequential or incidental damages arising directly or indirectly from the use of GoWin! including but not limited to any lost profits, or any other pecuniary loss, loss of information, business interruption, even if GoWin! Software has been expressly advised of the possibility of such damages. The End-User License Agreement shall be interpreted to the maximum extent permitted by law; it does not affect in any way your rights set by law. 3. REFUND POLICY - Your satisfaction is our top priority. If you are not satisfied with our product for any reason, you may request a refund within 14 days of your purchase date. To initiate a refund, please contact our support team with your purchase details. 4. COPYRIGHT - This software is protected by copyright laws and international copyright treaties. Purchase of GoWin! does not transfer any right, title, or interest in GoWin! software except as specifically set forth in this Agreement. All titles and rights to this software product are exclusively owned by the author. You may not reverse engineer, decompile, or disassemble any part of this software product. You may be held responsible for any infringement of such rights or violations to this Agreement. 5. GRANT OF LICENSE This Agreement grants you a personal, non-exclusive, non-transferable, non-sublicenseable limited license to use the Software Product as end-user, for non-commercial purposes. You are allowed to install the Software Product and use it on a single terminal connected to a single computer, for a single user and having a single installation at the same time. You are not allowed to copy or change this software program. You are not entitled to lease, rent or lend the Software Product to anybody. The license is valid only within the country the order was placed from. 6. LICENSE DELIVERY You agree that GoWin! Software, in its sole discretion, may change the license delivery mode despite of your choice and it may not be held responsible for any non-delivery or mis-delivery which may arise because of your insufficient cooperation or because of any other reason as long as GoWin! Software tried to deliver the license. Once delivered, or if a failure to deliver is due to your fault, a new delivery will be arranged at the discretion of GoWin! Software and additional charge may be incurred. You agree that GoWin! Software, in its sole discretion, may refuse the license delivery and refund the price, but any refunding fees which may arise shall be paid by you. 7. SUPPORT - GoWin! Software and any contributor to this software program are not obligated to provide support or updates for the product. However, any support or updates provided shall be covered by this Agreement. The support is mainly offered through the software�s help file or by on-line tutorials. Additional support may be provided by email, only in English language and only for requests written in English language. GoWin! Software, in its sole discretion, may refuse to provide this additional support, may charge a fee in order to provide it or may require customer identification prior to providing the support. 8. ACCOUNT CANCELLATION Any misuse of GoWin! Software�s products and services, any copyright infringements, any violations to this Agreement or any other law-breaking will lead to account cancellation. Also, the account cancellation may be done for account inactivity. These accounts will be considered abandoned. Examples of clear circumstances that will warrant an immediate account cancellation, including but not limited to: -The use of anonymous proxies and of any means that allow you to hide your identity or your real location; -Not allowing the full tracking or as requested by us, of your activity on our website and related to our products or services; -Providing erroneous identification data or the failure to prove your identity or your physical address with the methods proposed by us; -Multiple attempts to access the account with wrong credentials or from different locations or connections; -Accessing the account or attempts to access the account from more than one computer or from more than one country or using internet connections from different countries; -The commercial use of the products or services when the granted license is non-commercial; As an effect of account cancellation, any service provided to the customer will cease. No refund will be issued in this case. 9. DISTRIBUTION � Any version of GoWin!, demo, trial or licensed, may not be sold, distributed or modified in any way without prior written consent from GoWin! Software. 10. GOVERNING LAW This Agreement is governed by the laws of the author's country. Any disputes will be settled in the judicial courts of the author's country.
